01Acceptance of these Terms

These Terms of Use (the “Terms”) govern your access to and use of sparkpeakconsulting.co and any related pages, forms, and content (together, the “Site”), operated by SparkPeak Consulting LLC (“Spark,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

02About Spark

Spark works with medical spas and wellness practices to help them offer physician-guided programs. The Site provides general information about our services and lets you request a demo or contact our team.

Any services we provide to a practice are governed by a separate written agreement between Spark and that practice. If that agreement conflicts with these Terms, the written agreement controls.

03Not medical advice

Spark is not a healthcare provider and does not provide medical care, diagnosis, or treatment. Content on the Site is for general informational and business purposes only and is not medical advice.

Clinical services offered through programs we support are provided by independent, licensed healthcare professionals, who are solely responsible for their clinical decisions. Using the Site does not create a doctor-patient or other provider relationship with Spark.

If you have a medical emergency, call 911 or your local emergency number right away.

04Eligibility

You must be at least 18 years old to use the Site. If you use the Site on behalf of a business, you confirm that you have authority to accept these Terms on its behalf.

05Acceptable use

You agree to use the Site only for lawful purposes. You agree not to:

• Copy, scrape, or harvest content or data from the Site by automated means
• Interfere with the Site’s security or operation, or attempt to access it without authorization
• Upload or transmit viruses, malware, or other harmful code
• Submit false or misleading information, or impersonate any person or business
• Use the Site to send spam or unsolicited communications

06Intellectual property

The Site and its content, including text, graphics, logos, videos, and design, are owned by SparkPeak Consulting LLC or its licensors and are protected by intellectual property laws. The Spark name and logo are our trademarks.

You may view the Site for your own informational purposes. You may not copy, modify, distribute, or use our content or trademarks without our prior written permission.

07Information you submit and communications

When you submit a form, book a demo, or contact us, you agree that the information you provide is accurate and that we may use it to respond to you and to share information about our services. Our handling of personal information is described in our Privacy Policy.

By providing your email address or phone number, you agree to receive communications from us, which may include emails and text messages. Message and data rates may apply. You can opt out of marketing emails using the unsubscribe link, or of text messages by replying STOP. Consent to marketing messages is not a condition of any purchase.

08Third-party services and links

The Site may include links to or features from third parties, such as scheduling tools and video players. We do not control and are not responsible for third-party websites or services, and your use of them is subject to their own terms and privacy policies.

09Results and statements

Any figures, examples, or results described on the Site, including return on investment, timelines, cost savings, or patient growth, are illustrative and are not a guarantee or promise of any specific outcome. Results vary based on many factors, including each practice’s market, operations, and participation.

10Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.

11Limitation of liability

To the fullest extent permitted by law, SparkPeak Consulting LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Site.

Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

12Indemnification

You agree to indemnify and hold harmless SparkPeak Consulting LLC and its owners, employees, and partners from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or your violation of these Terms.

13Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute related to these Terms or the Site will be brought in the state or federal courts located in North Carolina, and you consent to their jurisdiction.

14Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

15General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them as part of a business transfer. These Terms are the entire agreement between you and us regarding the Site.
